Terms of service
The terms on which a university or college department uses LessonLayer. Plain words; where something is agreed separately with your institution, it says so.
1. Who we are and who these terms are for
1.1 LessonLayer is run by Greg Gorman, trading as LessonLayer ("LessonLayer", "we", "us"). We deal with customers by email only, at [email protected]; we do not publish a postal address.
1.2 These terms apply between LessonLayer and the university, college or other institution that takes a LessonLayer pilot or subscription ("the Institution", "you"). They cover the Institution's staff ("lecturers") who use the service with the Institution's access code.
1.3 Our privacy page and the data processing agreement we sign with the Institution form part of these terms. If they conflict on data protection, the data processing agreement wins.
2. The service
2.1 LessonLayer turns a lecturer's own teaching material (PowerPoint, Word, PDF, Markdown or text) into an interactive lesson ("the Service"). The lecturer's file is read in their own browser; only the extracted text is sent to us. The lesson is written with the help of an AI model: for institutions, Anthropic's Claude, provided by Anthropic PBC and processed in the United States.
2.2 Each department receives its own access code and uses the Service through the Create page at lessonlayer.co.uk/create.
2.3 A lesson can be downloaded as a standalone HTML file or as a SCORM 1.2 package for a VLE, which reports completion, and the student's place in the lesson so that they can carry on later, only to the Institution's own VLE.
3. Licence to use the Service
3.1 While these terms are in force, we grant the Institution a non-exclusive, non-transferable licence for its staff to use the Service for the Institution's teaching.
3.2 The Institution must keep its access code confidential and share it only with its own staff who need it. Tell us straight away if it may have been disclosed; we will stop it and issue a new one.
4. Your material and your lessons
4.1 Your material stays yours. The Institution (or its lecturers, as its own policies decide) keeps all rights in the teaching material it puts in. We claim no ownership of it.
4.2 You need the right to use it. The Institution and its lecturers are responsible for the material they upload, including third-party images, figures and quotations, and for having the right to use it in this way and in the resulting lessons.
4.3 Using the lessons. The Institution may use, adapt, copy and share the lessons it makes for its teaching, including on its VLE and websites. Sharing them outside the Institution needs our written agreement.
4.4 Activities in a lesson. A lesson may include interactive activities from the Open Psychology Interactives library or LessonLayer's own activities, built into the lesson file. The Institution may use those activities inside the lessons it makes for its own teaching. The Open Psychology Interactives activities are also available under their own open licences. Any other use of an activity needs our written agreement.
4.5 Edits. Lecturers can edit any text in a lesson during review. Edited text is the lecturer's own content: it is not checked again by the Service, and a lesson with edits is marked "lecturer-approved" in its file, never "verified".
5. Acceptable use
The Institution must make sure its staff do not:
- 5.1 upload student personal data, marks, or anything else about identifiable individuals beyond incidental mentions in ordinary teaching material (for example, the name of a cited researcher), including in speaker notes;
- 5.2 upload special category personal data (such as health information about an identifiable person) or criminal offence data;
- 5.3 upload material they do not have the right to use (clause 4.2), or material that is unlawful;
- 5.4 share the access code outside the Institution, or try to get around the access code, the rate limit or the balance;
- 5.5 try to disrupt, overload, probe or reverse engineer the Service, or use it to build a competing service.
We may stop an access code that is used in breach of this clause. We will tell the Institution why.
6. No training on your content
6.1 We do not use the Institution's material, or the lessons made from it, to train AI models, for analytics, or for anything other than making the lesson that was asked for.
6.2 The AI provider receives the extracted text, the file name and type, and any learning outcomes and key idea the lecturer typed. For institutions this is Anthropic PBC (United States). Anthropic processes that text as our sub-processor under its data processing addendum, deletes it within 30 days except where its usage policy or the law requires longer, and under its commercial terms may not train models on it.
7. AI output may contain errors
7.1 Lessons are made with the help of AI. The Service checks what it writes against the lecturer's material and refuses or flags what it cannot confirm, but a lesson may still contain errors, omissions or misleading statements. Facts, numbers and claims come from the lecturer's material; examples, questions and practice items are written by LessonLayer.
7.2 The lecturer must review each lesson before using it with students and is responsible for what is taught. A lecturer may keep an item the checks flagged; such a lesson is marked "lecturer-approved" in its file and the choice is recorded on the department's statement.
7.3 We do not guarantee that a lesson is accurate, complete or suitable for any particular teaching purpose.
8. Availability and support
8.1 There is no service level agreement during the Beta. We aim to keep the Service available, but it may be unavailable, slow or changed at times, including when the AI provider is unavailable.
8.2 Lessons already downloaded do not depend on the Service and keep working if it is unavailable.
8.3 Support is by email to [email protected]. We reply on working days (Monday to Friday, UK time); there is no fixed response time during the Beta.
9. Fees and the AI balance
9.1 The access fee and the scope of a pilot are agreed in writing with the Institution (an order form) before the pilot starts, and paid by invoice. We are not VAT-registered, so no VAT is charged.
9.2 Building lessons is paid from the department's prepaid AI balance, at the AI provider's cost, with no markup. Each lesson costs what its AI calls cost us: the tokens the provider reports, at the provider's list prices, converted to pounds at the current exchange rate, rounded to the nearest penny. The Create page shows the balance and an estimate before a lesson is made, and the actual cost when it is ready.
9.3 A lesson is charged when it is built and ready to use: when it has been made, its checks are complete and nothing is left for the lecturer to decide before it can be downloaded. It is charged whether or not it is then downloaded, and downloading it (as HTML or SCORM, as often as you like) is free. A lesson that fails, or that is blocked because it cannot be downloaded, costs nothing. A lesson that needs the lecturer's decision first (for example an item the checks flagged) is charged when it is first downloaded, and costs nothing if it is not downloaded within 24 hours.
9.4 While a lesson is being made, the most it could cost is set aside from the balance and released when it is charged or expires. When the balance cannot cover a lesson, no lesson is started and the page asks the department to contact us to top up.
9.5 The balance can only be used for building lessons. It does not expire while the department has access, and any unused balance is refunded on request when access ends. On request we send a statement listing every lesson charged and every top-up.
10. Term and ending
10.1 These terms start when the Institution accepts them (or signs the order form) and last for the period set out in the order form.
10.2 Either party may end these terms on 30 days' written notice. Either party may end them at once if the other commits a material breach that is not put right within 14 days of notice.
10.3 When these terms end we stop the Institution's access code and refund any unused balance on request (clause 9.5). The Institution keeps the right to use the lessons it has already downloaded (clause 4.3). No lesson content is held by us for more than 24 hours in any case; statement lines are deleted 12 months after access ends (see the privacy page).
11. Liability
11.1 Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
11.2 Subject to 11.1, our total liability to the Institution under or in connection with these terms is limited to the fees paid in the 12 months before the claim.
11.3 Subject to 11.1, we are not liable for indirect or consequential loss, or for loss of profits, data or goodwill.
12. Changes to these terms
We will give the Institution at least 30 days' written notice of any change to these terms. A change never applies to balance already paid for without the Institution's agreement.
13. General
13.1 These terms, the data processing agreement and any order form are the whole agreement between the parties about the Service.
13.2 Neither party may transfer these terms without the other's written consent, which is not to be unreasonably withheld.
13.3 If any part of these terms is found to be unenforceable, the rest remains in force.
13.4 These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
14. Free trials
14.1 A free trial lets one person make one lesson from one file of their own teaching material and use it in their web browser, on our website, for 24 hours. It is free. A trial code works once and cannot be used again, transferred or sold. Unused codes expire after 14 days.
14.2 A trial lesson contains the core lesson only. It cannot be downloaded as HTML or SCORM, and its optional "Go deeper" pages are not included. To use LessonLayer lessons in your teaching, you need a pilot (section 2).
14.3 Sections 4 (your material and your lessons), 5 (acceptable use), 6 (no training on your content) and 7 (AI output may contain errors) apply to trials. You must have the right to upload the material, and it must not contain student personal data.
14.4 We offer trials at our discretion. We may refuse a request, limit how many trials run at the same time, pause trials, or end them at any time, without notice. Trials come with no service levels and no support beyond answering email.
14.5 Trials are provided as they are. To the extent the law allows, we have no liability for a free trial.
